BETATHLON LTD’s GENERAL BETTING RULES

Explanation of terms

In these regulations, unless the context requires otherwise, all terms and terminology will be interpreted and shall have the meaning given to them by the Betting Law of 2019.

"General Regulations": These are the regulations issued by the "Company" which govern the way in which betting is carried out between the "Company" and its Members.

“Company” – means Betathlon Ltd.

"Law" – means the Betting Law of 2019 and/or any other law that arises which regulates Class A and/or Class B bets and the regulations issued thereunder from time to time.

«Member» - A person who has participated in the Bets offered by the Company and to whom at least one Betting Slip was issued.

«Odd» - means the price offered by the Company for any particular event.

This price, when multiplied by the value of the unit of the bet, results in the winning amount of the "bet".

«Coupon» - Description of the events offered by the Company for placing bets, which are published in a printed or electronic form for betting purposes and for the information of the public.

“Bet” – The written agreement between the Company and the Member which includes the betting options, the date on which the bet is carried out, the «Odds» of these options, the amount of the bet and other details. This agreement is subject to the regulations of the Company. 

«Bet acceptance system» - the computer system approved by the National Betting Authority with which the "Company" has the license to accept bets via computer within the premises licensed by the National Betting Authority.

«Betting Slip» - printed by the Company’s terminal which describes the Bet and which the Member receives as proof. The «Betting Slip» includes information about the betting shop of the Company's where it was placed, the unique identification code, the events selected by the Member, the times of their conduct, their Odds, the description of the Bet type, the bar code and other details foreseen in the guidelines of the National Betting Authority and which is approved thereby. The «Betting Slip» is the only contract between the "Company" and the "Member" that proves its existence and ownership by the "Member".

«Regulation» - This text which describes the general terms and conditions governing the conduct of betting between the Company and its Members, as well as additional conditions contained in the Betting Slips, in the Coupons and in the announcements  posted on the Betting Shops which are licensed by the Company or announced through the press or electronic means which constitute official premises of the Company such as teletext or websites. The regulations enter into force following their approval by the National Betting Authority.

«Agent» - an authorized natural or legal person licensed by the National Betting Authority which provides betting services on behalf of the Class A recipient within a licensed establishment, following the conclusion of an agreement between the two parties – between the Class A recipient and an authorized representative.   

“Date of profit calculation” - the time at which a “Bet” is defined and recognized as won.

'Live Betting' - a “Bet” on events which are underway/in progress.

GENERAL

 

1.1.  EFFECTIVE DATE OF REGULATIONS

The following Regulations apply as from the 09-05-2021 following the approval of the National Betting Authority and govern all Bets accepted by the Company, regardless of whether the Member was informed about them or not. However, in case of a dispute, the Company will try to resolve Member complaints directly with the Members. The Members of the Company must read, accept and follow the Regulations before depositing their Bet. Owning a “Betting Slip” issued by the Company implies what is stated and on the betting slip itself, i.e. that the Member recognizes and accepts the Regulations set out and which he may consult at the Betting Agent (Agent) or in any other official area of the Company.

1.2.  WORKING HOURS

The lawful activities of Betting Agents (Authorised Agents) may take place only during the specified working hours according to the Company. The Company reserves the right to cancel, if it so wishes, any Bet played after the opening hours of its head offices, even if the Bet had been accepted by its Bet acceptance system and the relevant betting slip had been printed. For example if a Betting shop (Authorised Agent) carries out business outside of specified business hours in accordance with the Company and the Regulation of the Operation of Shops and the Conditions of Employment of their Employees Act of 2006 (155(I)/2006) as amended, e.g. at 3 a.m. and mistakenly accepts Bets in the Company's Bet acceptance system from which a relevant receipt has been printed then the Company can cancel these bets.
The working hours of the Company are announced on the official premises of the Company and it is noted that they must comply with the opening hours of general stores in accordance with the Regulation of Store Operation and the Conditions of Employment of their Employees, Law of 2006 (155(I)/2006) as amended.

 

1.3.  PROHIBITION OF THE ACCEPTANCE OF BETS

It is strictly forbidden to accept Bets by persons under 18 years of age.

1.4.  VALIDITY OF ACCEPTANCE OF BETS

No Bet is acceptable and/or valid before the Member has in his hands a valid proof, the Betting Slip, which is subject to the Regulations of the Company. The Company reserves the right to refuse to accept all or part of any Bet, the moment it is offered.

Bets placed through the Company's terminals are accepted only if they have been submitted according to the generally approved betting procedure of the Company. No other Bet acceptance procedure is allowed unless it is approved by the Company. Only Bets registered in the computer records of the Betting Shop and, by extension, in the computer files of the Company will be validated and accepted. The Member is required to check that the Bet printout from the computer corresponds to the requested Bet. If it does not correspond, the Member must request the cancellation of the Bet.

1.5.  CANCELLATION OF BETS

The Member may request the cancellation of his Bet within 5 minutes of its printing. However, if a game included in the Bet has started before this time has elapsed or has options the Odds of which have been changed, then these Bets cannot be cancelled without the approval of the Company.

There can be no cancellation in respect of Live Betting.

Cancellation of Bets which do not involve void matches or games or Odds that have changed may only be requested in the following cases:

•    If due to a mistake in the computer of the Betting Shop/Agent, the Bet was not registered.

•    If the computer does not print a receipt.

If more than 10 minutes have elapsed from the time the Bet was accepted, the cancellation request has to be received by the Company’s staff, by email or fax, before the start of the first event of the Bet. The Company has every right to refuse to cancel any Bet.

1.6.   TIMING OF ACCEPTANCE OF BETS

The Company reserves the right to declare as void any Bet/selection reaching its network, conveyed by a Betting Shop (Agent), if it was entered, either by mistake or due to an error of the Company's Betting System, after the start of the event to which the Bet/selection refers. The same applies to Live Betting in case a Bet/option is registered in the system of the Company after its completion.

Predictions for events not carried out or postponed for any reason, shall be deemed VOID in the Betting Slip regardless of whether the match takes place the next day or any other close day.

The Odds of the above predictions for the purpose of profit calculation are 1.00 (1 unit).

The date and starting time of an event is the date and time that the event actually begins and not the start date and time advertised by the Company.

When a Bet comprises several selections of events, and one or more of the events to which it refers, is already underway or has finished at the time the Bet is received by the Company, the selection(s) are calculated with odds of 1.00 unit. 

The remaining selections are valid and will be recognized as such as long as they meet the minimum requirements of the options that render the Bet valid.

Example 1

Bet (PREMATCH) €10 Total of 5 teams provided that a minimum of 3 selections are acceptable.

If the JUVENTUS and MILAN match has already begun when the Bet was accepted by the Company, the Bet will be deemed to be a Bet of 3 teams worth €10, with JUVENTUS and MILAN rated at the Odd of 1.00 unit.

Bet (PREMATCH) €10 Total of 3 teams provided that a minimum of 3 selections are acceptable.

Example 3

Bet (PREMATCH) with a Cyprus football team - €10 Total of 6 teams provided that a minimum of selections are acceptable according to section 22 of P.I. 102/98 (see 1.8).

If the JUVENTUS and MILAN match has already begun when the Bet was accepted by the Company, the Bet will be deemed to be a Bet of 4 teams worth €10, with JUVENTUS and MILAN rated at the Odd of 1.00 unit.

Bet (PREMATCH) with a Cyprus football team €10 Total of 4 teams provided that that a minimum of selections are acceptable according to section 22 of P.I. 102/98 (see 1.8).

If the JUVENTUS match has already begun when the Bet was accepted by the Company, the Bet will be void because the other three teams do not complete a regular Bet in accordance with the Regulations.

1.7.  RECORDING, VALIDITY OF BETS

Every Bet validated by the Company will be registered in the general archive of the Company and for security reasons also in a second archive, called ‘security archive’. The Odds applicable at the time the Bet is registered are the odds based on which the potential winnings will be calculated. When the winnings are calculated, only the content of the receipt in the archives held in the Company is valid. If the receipts of the Member have different data than those stored in the archives of the Company, the Company reserves the right to consider as valid only the data contained in its security archives. It is noted that if the above happens, the Company shall have an obligation to adequately justify the event.

Any details contained in the receipts that a Member holds concerning the minute when the match is carried out (if the Bet is carried out during Live Betting matches) at the time the Bet was placed, shall not be binding on the Company.

1.8.   DETAILS OF ACCEPTANCE OF BETS - CHANGES OF ODDS

All betting selections, to be considered eligible for placing bets (either alone or in combination with others), must meet the minimum number of bets attributed to them and recorded in the Company's Bet acceptance system. If the minimum number of selections is not met, then the Bet is not accepted. Whenever the Company deems appropriate, it has the right to change the minimum number of selections with which a bet can be placed either alone or in combination with other selections. According to section 22 of P.I. 102/98, where football bets are concerned, a Bet placed on the outcome of matches between Cypriot teams either in the territory of Cyprus or abroad shall be permitted only when placed in combination with the outcome of matches of at least three other foreign teams.

The Company reserves the right to change any Odds at its discretion. The actual Odds for any selection always remain the Odds at the time of validation of the Betting Slip unless it is a typing error (see Regulation 1.14). For this reason, Members are urged to check their Betting Slips very carefully.

1.9.   APPROVAL OF BETS

If the Betting Shop/Agent receives requests for Bets that exceed one or more of the prescribed betting limits set by the Company, it will be necessary for the person in charge to request a special authorization for the total and/or partial acceptance of such Bet, in accordance with the Regulations and the procedures prescribed by the Company.

The prescribed betting limits set by the Company are as follows: 

-    For bet categories included in the LOWER LEAGUES category, the limit is €200 (two hundred euros)

-    For all other bets, the limit is € 500 (five hundred euros)

1.10.    SELECTION OF RELATED BETS

The combination of related selections for placing Bets on the same or on a different event, even if the Company accepts such a specific Bet by mistake, when the outcome of one selection affects the outcome of the other selection (e.g. the combination of MAN UTD to WIN and MAN UTD CORRECT SCORE 2-1 is not allowed in the same match, the combination of L. HAMILTON to win in the qualifiers and in the match of a FORMULA 1 event etc. is also not allowed). This regulation applies to all types of bets offered by the Company. 

If such a Bet is accidentally accepted by our Company’s Bet acceptance system, the amount of the Bet will be divided equally for each reported probability.

The following are exceptions to this rule:

a) Bets where a special type of Bet with a specific odd is offered for these connected options

b) when the Company explicitly states in its regulations and in its Betting offer that the specific Bets are combined.

1.11.     UNCLEAR BETS

The Company reserves the right to consider Bets as unclear and therefore void, even if they have been accepted by the computer of Betting Shop/Agent, even if the Member has received the Betting Slip. Unclear Bets are considered to have an ambiguous interpretation. The cancelled Bet is then returned, at the request of the Member. The Company is not responsible to locate the Member to return the money to which he is entitled. An example of a bet that is unclear is the selection of a team, player, competitor to win an event where the Company has mistakenly omitted to specify who is being referred to by not listing his/her full name, e.g. MANCHESTER to win the CHAMPIONS LEAGUE where both MANCHESTER UNITED and MANCHESTER CITY can participate or WILLIAMS to win the AMERICAN OPEN where VENUS WILLIAMS and SERENA WILLIAMS can also participate.

1.12.    PAYMENT OF WINNINGS

The payment of the winnings will be settled only by presenting the authentic Betting Slip which includes the authentication code and authorizes payment from the computer of the Betting Shop/Agent. The Company shall not have any responsibility in case of payment of profits in any way other than the above. Any other form of payment of winnings shall not be accepted nor recognized and/or shall not be valid for the Company. Provided that in cases where any license in respect of any premises expires or is terminated, then the Company shall be liable to pay the winnings.

Any Bet won can be cashed in up to one (1) month after the Profit Calculation Date. Any Bet not cashed in during the period of one month mentioned above, will be considered by the Company to be expired and worthless, except in the event that the winning player was unable to redeem his Bet within one month due to proven absence abroad or other serious impediment.

The winning Bet can be cashed in only by the same terminal from which it was issued. In the event of a loss, total or partial destruction or, in general, in any case where it is not possible to locate and recover a winning Bet, the claim for the payment of winnings and any other claim for compensation by the Company is ruled out. If the result of an event cannot be officially verified, the Company has the right to delay any payment until the official verification. In the event of an incorrect calculation of profits, the Company reserves the right to correct it before and after the payment of the winnings. 

1.13.     MAXIMUM LIMIT OF PAYOUTS

Every Bet is subject to a maximum win established by the Company. The maximum win for each Bet offered by the Company is set out in special Appendix A which is attached to the Regulations. 

The maximum win for a Bet which is accepted may be less than the calculation of the Bet acceptance system of the Company (which is given on the coupon receipt) and the responsibility belongs to the Member who must stake his bets accordingly, knowing the maximum limit he can claim. In such cases the limits specified in the Regulations shall always apply. 

If a Bet involves a selection(s) which concerns different kinds of Bets, then the lowest maximum pay out limit of the particular kinds of Bets applies to the whole Bet.

Example

A Bet on 1 football selection and 1 basketball selection is calculated on the maximum payment limit for the basketball game (the maximum pay out limit for the basketball game is smaller than the football selection). 

All maximum pay out limits mentioned in these Regulations, shall apply to any one Member, or group of Members betting together, betting the same or similar combination of selection(s), even if this is done in a series of Bets, in a series of Odds, in a number of days, using different Betting Shops/Agents. If the Company has grounds to believe and determine that a Bet or number of Bets have been played in this way, the final payment of all those Bets combined will be limited to the single maximum pay out mentioned above. It is understood that sufficient documentation will be provided to the players to prove the above which will justify the final payment.

1.14.     TYPING AND OTHER OBVIOUS ERRORS

In case of improper printing of Odds, mistakes in the betting slips or obvious errors in the data entered into the Bet acceptance system of the Company, the Company reserves the right to cancel such Bets or to settle such Bets at the correct Odds, even if the discovery of the error occurs after the event is completed.

The cancelled Bet is returned at the request of the Member. The Company accepts no responsibility for the validity of the information it provides to its Members regarding the dates and start times of matches or games, the rankings or any other information that may be considered significant by Members.

No mistakes made by the Member, the Company staff or its betting shops are recognized and the checking of all Bets for any winnings shall be made according to the Regulations.

Any obvious typing error in the indication of the Odds issued by Company or any error in the Odds of the Company contained in the Coupons and other forms issued by Company, shall not be binding on the Company. An obvious typing error the indication of the Odds issued by Company or any error in the Odds of the Company is deemed to be:

-  any Odd which is at least 30% higher or lower than the average of the prices for the specific Bet or combination of Bets given by the betting companies in Cyprus (those holding a legal betting licence in the Republic of Cyprus).

-  any Odd which is comparatively dissimilar by comparison to other similar Odds of the Company. For instance, where football bets are concerned, in order for some Odds to be considered similar they must be similar based on the 3-Way bet relationship and TOTALS Χ GOALS must be similar. E.g. if we have the following options

- it is clear that the Odd for the CORRECT SCORE of the TOTTENHAM - CHELSEA match is comparatively different from the other 2 Odds. In this case the Company has the right to refuse to pay the winnings with the specific Odd of the CORRECT SCORE of the TOTTENHAM - CHELSEA match and to pay according to a logically similar Odd.

- any Odd which is wrong on the basis of logic and mathematics e.g. Odds which obviously give the Company a disadvantage vis-à-vis its Members in their entirety. The proof of the disadvantage is based on the equation M = (1/odd 1 + 1/odd 2 + 1/odd 3 +1/...) - 1. If M is less than 0 (negative sign) then the Company has a net disadvantage. The above does not apply where the Company advertises on official sites that it is deliberately disadvantaged vis-à-vis its Members regarding the particular Odd.  

In such cases the betting slip issued by the Bet acceptance system of the Company shall not be binding on the Company if and when it contains incorrect Odds.

The Odds of the matches given on teletext or the Live Betting service of the Company are for information purposes and shall not be binding on the Company. Also, results of events given on the teletext service are for information purposes only and are not binding on the Company. Also, results of events which are listed in the teletext service, serve informational purposes and do not bind the Company.

1.15.     REQUESTS AND ANOMALIES

Where there is any suspicion or indication or evidence of dispute or anomaly regarding any event, the Company reserves the right to cancel or suspend payment on the disputed selection, pending the completion of the investigation that may or could be carried out by the official or other competent or authorized body or authority responsible for the relevant event.

The Company will seek criminal and contractual sanctions against any Member involved in fraud, dishonesty or criminal acts. The Company shall withhold payment to any Member where there is suspicion or indications about any of the above. The Member shall indemnify and be legally responsible to pay the Company on demand, all costs, charges or losses to be incurred or to be borne by the Company (including any direct, indirect or consequential damage, loss of profit and reputation) and which result directly or indirectly from fraud, dishonesty or a criminal act of the Member.

The Company reserves the right to withhold payment and cancel Bets concerning an event if it has evidence that the following has occurred:

(a) there are questions concerning the integrity of the event

(b) An Odd(s) or Bet has been forged, falsified

(c) A match was "rigged"

Evidence of the above may be based on the size, volume or structure of the Bets that were placed with the Company, through any or all of our betting procedures.

Any decision taken by the competent sporting body or competent court (if any) will be convincing and final. If any Member owes any money to the Company or to our Agents for any reason, we have the right to take this into account before making any payments to such Member. Where there is evidence of a series of Bets and each one includes the same selection or selections and Bets have been placed by the same individual or group of individuals, the Company reserves the right to cancel the Bets or withhold the payment of winnings when the outcome of such investigation is pending.

1.16.    REQUESTS - CLARIFICATIONS - COMPLAINTS - BETTING DISPUTES

For any requests/clarifications regarding the recording of a specific Bet, Members should contact the Agent of the Company where the specific Bet was recorded. The Agent of the Company has the absolute responsibility to record the Member’s Bet and the Company shall not be liable if the Member's Bet has not been recorded in the Bet acceptance system in the manner indicated by the Member to the Agent.

For any complaint/betting dispute the Member shall communicate with our Company and specifically with the Complaints Department, where he will receive detailed explanations (also verbally) regarding the procedure in which a complaint can be submitted and examined.

 

The procedure is as follows:

a) the Member must disclose and deliver his data to the Company which will be used for correspondence regarding his complaint/Bet dispute. Provided that if necessary or required, such data may also be used in accordance with Regulation 2.8. PERSONAL DATA. 

b) the Member must formulate his complaint/Bet dispute by setting out the necessary details by filling in the relevant complaint form and sending it to the headquarters of the Company either in person or electronically, within 31 days from the completion of the event concerning his complaint. Members will automatically receive a copy of their complaint. The Member will also be informed about the control systems applied by the Company in order to avoid an unauthorized or unwanted disclosure of data or information related to his complaint/Bet dispute.

c) the Company will process the complaint/Bet dispute and will inform the Member about the decision of the Company within ten days from the receipt of the complaint/Bet dispute.

Where the specific complaint/Bet dispute cannot be resolved by mutual consent, it will then be referred to arbitration under the Arbitration Law, Cap. 4 of the Republic of Cyprus unless the Betting legislation applicable in Cyprus or the regulations issued by the National Betting Authority indicate any other dispute resolution process which will prevail over arbitration.

The Member also has the right to report his complaint to the National Betting Authority (email complaints@nba.gov.cy) by following the procedure for the submission and examination of complaints in accordance with the instructions (Decree 20/2017 - Procedure for the Submission and Examination of Complaints or any decree that may replace the above) and the regulations of the Authority.

1.17.    MATCHES/EVENTS WHICH WERE INTERRUPTED AND/OR POSTPONED

If some event/match is interrupted before its end, the event/match shall be deemed VOID and will be paid at an Odd of 1.00 (one unit), except for selections of the event/match which have already been decided (in whole or in part). The selections shall be deemed to have been decided (in whole or in part), when they are already lost or won based on the outcome at the time that the match/event was interrupted and the outcome could not have been different if the event/match had continued. 

For instance, in football if the hypothetical LIVERPOOL-ARSENAL match was interrupted at the 60th minute and the outcome was 0-0, then all Bets that have not been decided, such as the Match Winner prediction selection (FULL TIME RESULT), shall be void, except for any other selection that has already been decided such as the HALF TIME BET selection that has already finished (result X). 

In this case, those who had bet X on the half time result (tie) win and those who had bet on the half time result 1 or 2 lose, because if the match continued, the result of the Bet would not change. Those who had bet on the Match Winner prediction selection (FULL TIME RESULT), will get their money back because if the match had continued, then the result could have changed.

An event/match which is interrupted is not considered to be a completed match if its duration is completed for any reason on another day than the usual day that the match had taken place. 

This does not apply to Tennis matches. Bets on Tennis matches are cancelled only if they are not continued and are not completed until the end of the championship for which they are competing.

Results given by various other Bets (of other companies) or by other companies for postponed matches after a draw are not valid (Pools).

Matches/events that were scheduled to take place on a specific day and have been postponed shall be considered void if bets had been placed on them as shown on a Betting Slip of the Company, before their postponement by the Company is finalised. However, if bets are placed on these matches/events after the Company changes their date and the Betting Slip states the new date on which they will be conducted as the new date, then this selection shall be valid as usual.

1.18. REVERSAL OF HOME GAMES, NEUTRAL PITCHES, OWN GOAL, REGULAR MATCH DURATION, NAMES OF TEAMS.

When a match is played on the other side’s field than the one indicated on the Coupon issued by Company, the match will be VOID unless it is a match played in a neutral court. If a team has a different opponent than the one mentioned on the Coupon, then the match is again void. For betting purposes, when a match is played on a neutral pitch, the team on the left will be counted as the home team (HOME).

A neutral field for Betting purposes is always the result of a penalty of the home team. In any other case, the field is not neutral, unless the competent federation under which the specific game is conducted designates a neutral stadium for the match in question (final game of the championship, etc.). The selection of a match played in a neutral field is VOID, unless the fact that the match will be played in a neutral field is stated in the brochures containing the events and odds.

The Company is not obliged to indicate, in its brochures of events and odds, whether a match is held in a different field than the field of the home team but is not considered by the competent authorities as neutral.

Nevertheless, if the Company mentions the field of the home team in its brochures of events and odds, it does not mean that it considers it neutral.

If a team selects a specific field (other than its home field) for a number of matches for a variety of reasons, this is not considered neutral.

Regarding Bets on goal games, each own goal counts for the opposite team and not for the one that scored it.

From time to time, there are matches/events (friendly games, youth games, e-sports Football or other events) of any sport, which are scheduled to last more or less or at different times (halftime/periods) than their usual regular duration (in the championships in which they participate). In such cases, if the Company does not specify the correct duration in its Betting offer, then the Bets on these matches will be cancelled except in the case of football matches where the following will apply:

Matches/events that last 90 or 80 minutes and have some differences will be valid and will be settled as follows:

- 90 minutes of scheduled play (in which there are more than 2 half times and each half lasts for a period of time that is not 45 minutes, e.g. 3 half times lasting 30 minutes).

Bets (before the start of the match but also during Live Betting) of regular duration will be considered valid. Half time Bets (before the start of the match but also during Live Betting) will be considered void.

- 80 minutes of scheduled play (in which there are more than 2 half times and each half lasts for a period of time that is not 40 minutes e.g. 4 half times lasting 20 minutes).

Bets (before the start of the match but also during Live Betting) of regular duration will be considered valid. Half time Bets (before the start of the match but also during Live Betting) will be considered void.

- 80 minutes of scheduled play (in which there are more than 2 half times and each half lasts for a period of time that is not 40 minutes). 

Bets (before the start of the match but also during Live Betting) of regular duration will be considered valid. Half time Bets (before the start of the match but also during Live Betting) will also be considered valid.

Otherwise, where the regular duration of the match is not 90 or 80 minutes and this has not been clarified by the Company from the start, the match shall be deemed void (VOID) and the bets placed thereon will be paid at an Odd of 1.00 (one unit).

The Company shall not be liable and is not obliged to inform its Members about the correct schedule of games. It is the responsibility of the Members to know the correct schedule of games before Betting.

The match referee is responsible for deciding when a half time or/and the game ends. The Company shall not be liable if the full allotted scheduled time (injury time or other) is not played after a decision made by the referee. Differences regarding the scheduled playing time will not be a reason for cancelling the Bet.

 

Example

At a 90 minute game the referee decides to whistle the end of the regular time of the match after 85 minutes. For the purposes of Bet settlement, the game is considered to have covered the full duration of the match according to the referee and will be settled like a normal game according to its end result.

At a 90 minute game with two 45 minute halves the referee decides to whistle the end of the 1st half after 40 minutes. For the purposes of Bet settlement, the game is considered to have covered the full duration of the 1st half according to the referee and will be settled like a normal game according to this result.

The Company shall not be liable if a mistake or omission is made regarding the name of the team/player/contester. If the name of a team is entered incorrectly and the interpretation is ambiguous or different from the actual one, then the specific team selection is void (VOID). If the name of a team is misspelled and the interpretation is ambiguous, then the specific team selection is valid.

 

Examples:

1.  If a match is held in the Under-20 Youth Championship which is mentioned in the offers provided by the Company and the match is shown and offered in the system as ENGLAND - FRANCE (without writing U20 next to the name) the selections regarding the match will be usually valid.

2.  If a match is held for a championship in England and the match is mentioned and offered in our system as MAN UTD - LIVERPOOL, while for advertising or other purposes LIVERPOOL has changed its name for the specific season and is officially listed in the championship with the name of the advertiser and not LIVERPOOL, the selections regarding the match will be valid.

3.  If a match is held within the course of any championship which is mentioned in the offers provided by the Company and the match is spelled wrong when mentioned and offered by the system but this spelling error does not affect the actual interpretation of the name of the team that is mentioned, then the selections regarding the match will be valid, e.g. if the match held within the course of a championship in England is mentioned and offered by our system as MAN UTD - LIVERPOOL M or MAN UTD – LIVERPOL, it will be valid as usual.

4.  There may be teams with the exact same name in the computerized system of the Company, but it is shown clearly that they are competing in different championships. In such cases the Member is initially bound by the selection of the event and not by the name of the team. E.g. it may be that the computerized system of the Company mentions BARCELONA as competing in the Men's championship but also mentions BARCELONA as competing in the Women's championship. The Member is then obliged to make sure that his Bet correctly states the event for which he wants to place a bet on.

5.  In the case of Ante Post Bets, if a Bet is placed on a team whose name is changed during the match/event, the Bet selections regarding that team will be valid as they relate to the same team to which the Bet referred at the time that it was placed and not to a new team that was created later.

1.19.   LIABILITY OF MEMBERS

By submitting the Betting Slip in order to Bet, the Member irrevocably declares that he has read, understood and fully accepted the Regulations of the Company as they are displayed in the official locations of the Company and recognizes that acceptance of the Betting Slip is made on condition that he checks and makes sure that it complies with the regulations and announcements of the Company, after informing and obtaining the approval of the National Betting Authority.

All Members are obliged to make sure that they have completed their Betting Slips clearly according to their predictions and instructions. For this reason, responsibility for their correctness is up to the Member.

Errors made by the Member, by the staff of the Company's head offices or by the Agents of the Company shall not be recognized and the checking of all Bets for possible wins shall be made in accordance with the Regulations of the Company.

All Bets, after they are entered in the Company’s Bet acceptance system through the Agent shall be subject to the condition that they are valid according to the Regulations of the Company. If there is no compliance with these Regulations in respect of any specific Betting Slip, the Company shall not be legally liable to the Member.

1.20.   AMENDMENT OF THE REGULATIONS

The Company reserves the right to amend the Regulations as well as to issue new ones with a relevant announcement after informing and obtaining the approval of the National Betting Authority. Any previous Regulation of the Company is considered invalid if a new Regulation has been issued by the Company that replaces the previous Regulation after informing and obtaining the approval of the National Betting Authority.

 

1.21.   TECHNICAL PROBLEMS

The Company shall not be held responsible if due to technical problems the validation of a Bet becomes impossible.

 

1.22.   APPENDIX Α

Appendix A describes all types of betting offers as well as their maximum payout limits. Appendix A is part of our Company Regulations.

1.23.   COMBINATION BETTING

The regulation refers to the following bets:

First Goalscorer And First Goal Interval, Last Goalscorer And First Goal Interval, Anytime Goalscorer And First Goal Interval, First Goalscorer And Correct Score, Last Goalscorer And Correct Score, Anytime Goalscorer And Correct Score. Where the Company offers bets which consist of a combination of two or more options/types of bets, they will be settled after all parts of the combined bet have participated or carried out normally. If one of the options/types of bets of the combined bet has not participated nor carried out, then the Combined Bet will be void regardless of the outcome of the other parts of the options/types of bets concerning the bet. Furthermore, if one of the options/types of bets of the combined bet has participated but after the outcome of part and/or the entire bet was decided, then the Combined Bet will again be void regardless of the outcome of the options/types of bets concerning the bet.

E.g. in combined bets

FIRST GOALSCORER AND CORRECT SCORE: RONALDO AND 3-2 CORRECT SCORE, if RONALDO did not play then Combined Bet is void regardless of the game’s outcome.

FIRST GOALSCORER AND CORRECT SCORE: RONALDO AND 3-2 CORRECT SCORE, if RONALDO entered the game after the 1st goal was scored (that is, he participated after the Bet FIRST GOALSCORER was decided) then the Combined Bet is void regardless of the game’s outcome.

FIRST GOALSCORER AND CORRECT SCORE: RONALDO AND FIRST GOAL INTERVALS 11-20, if RONALDO entered the game after the 1st goal was scored, and that goal may have been scored even between the 11th and 20th minute (i.e. it participated after the Bet FIRST GOAL INTERVALS was decided regardless of whether the other part of the bet lost or won) then the Combined Bet is void regardless of the game’s outcome.

1.24.   CASH OUT

The Cash Out function is the function in which the Member has the ability to settle and redeem his Bet prematurely (before and regardless of the final outcome), whereby the Company will offer to give him part of the winnings he would have received according to his Bet, provided that his Bet was winning at the time of the Cash Out request.

Procedure for requesting a cash out

The Member places his Bet in the Licensed Agent's premises. The Agent or the authorized personnel of the Agent validate this Bet in the Company’s approved Betting system which issues the betting slip which is delivered to the Member.

If the Member wishes to use the Cash Out function, he must request, verbally and/or electronically by scanning the QR code (two-dimensional barcode) the cash out from the Agent or the authorized staff of the Agent or the Company. The Agent or the authorized staff of the Agent or the Company will check the Company’s approved Betting system if the Cash Out option is available for the specific Bet. 

(a) If the Cash Out option is available then the Agent or the authorized staff of the Agent or the Company will inform the Member of the Cash Out amount offered by the Company for his Bet.

If the Member accepts the Cash Out amount offered, then the Agent or the authorized staff of the Agent will record the Member's intention to Cash Out his Bet in the Company’s approved Betting system. If the Member’s Cash Out request is made electronically, then the Member's intention to Cash Out his Bet will be automatically recorded in the Company’s approved Betting system.

-     If for any reason during the procedure described above, the Cash Out amount offered by the Company for the Cash Out of the Bet changes or there is no possibility for Cashing Out the Bet, then the Cash Out process cannot be completed, and the Agent or the authorized staff of the Agent or the Company will inform the Member who will in turn decide whether he wants to request a Cash Out again later.

-     If the Cash Out amount offered to the Member is the same as the amount offered initially to the Member, the Agent or the authorized agent of the Agent or the Company will validates the Cash Out and the Agent or the authorized staff of the Agent will pay the Cash Out amount to the Member and will also give him the receipt for the payment made to him which will be issued by the Company's approved Betting system.

b) If there is no possibility for the Member to Cash Out his Bet, the Agent or the authorized staff of the Agent or the Company will inform the Member.

The rules governing Cash Out are as follows:

1. The Cash Out function is available for select Betting events both before as well during. The Company expressly advises its Members not to place Bets based on the assumption that a Cash Out option will be available at a later time for the Bet they have placed. The Cash Out function can be used on all types of bets (single, multiple bets and systems) unless a Bet includes at least one option that is not offered for Cash Out. The Company does not guarantee that the Cash Out function will be available for each betting option even if it has been offered for the same event or for the same type of bet in the past. The Company reserves the right, without the obligation to justify its decision, to accept or deny a Cash Out request submitted by a Member.

2. From the moment that a Cash Out request is submitted and until it is accepted, there is a reasonable period of 10 seconds, during which the Cash Out amount offered by the Company to the player cannot be changed. After this reasonable period of time, the Cash Out amount offered to the player by the Company may be changed and cancelled due to a change in the Odds offered, such as for instance in the following cases: change of Odds by the Company, scoring of a goal, termination or postponement or cancellation of a Betting event, etc.  

If the Cash Out amount that is offered changes immediately after the Member's request and before the Cash Out is completed, then the Cash Out will be blocked and may not be completed unless the Member accepts the change of the Cash Out amount that is offered. 

3. If the request for Cash Out is successful, then the Bet will be settled immediately and the actual final outcomes of the relevant matches will not have any effect on the Cash Out amount. The Cash Out amount offered at any time is the total amount that will be refunded to the player if the Cash Out request is successful.

4. The Company reserves the right to withdraw the Cash Out offer (even if it was offered) at any time for any Betting events, before and during.

5. The Company is not responsible if the Cash Out function is not available for technical reasons. During this time, all Bets will be valid as originally placed.

6. If a match is interrupted but the Cash Out process took place before the interruption, then the Cash Out amount will apply and not the possible refund of the money for this Bet. If the Cash Out took place after the interruption, then the Company reserves the right to cancel the specific Cash Out.

7. If a Cash Out settlement of a bet is accepted following an error in the Cash Out offer during the course of live betting (e.g. misinformation about the match, cancellation of a goal, change of decision due to VAR), then the Cash Out settlement of the bet will be cancelled and the Company will make a new Cash Out offer, if possible, to the Member if he so requests. If the Member does not make a new Cash Out request, this Bet will then be settled according to the corrected odds of the Company.

If a Cash Out settlement of a bet is accepted due to a typographical or other obvious error (Rule 1.14), then the Cash Out settlement of the bet will be cancelled and the Company will make a new Cash Out offer, if possible, to the Member if he so requests. If the Member does not make a new Cash Out request, this Bet will then be settled according to the corrected odds of the Company.  

8. The Company will not accept any request by a Member for the reversal or cancellation of a successful Cash Out.

9. If a Cash Out request is accepted by the Company when the outcome of the relevant Bet has already been determined, the Company reserves the right to cancel the Cash Out. Furthermore, the Company reserves the right to cancel and claim back any amounts paid for Cash Out if there are suspicions of abuse of the Cash Out function. An example of "Cash Out" abuse is Betting on incorrect odds that arise in accordance with the General Betting Regulations / Condition 1.14 and cashing out using "Cash Out" after they have been corrected. In such a case there is a guaranteed profit in favor of the Member and a loss against the Company. It is understood that the incorrect odds at the time of the Bet were higher than the "Cash Out" odds. Bets already accepted for Cash Out can only be cashed out at the shop of the licensed Agent where the Bet was originally placed.

10.  Bets for which the application for "Cash Out" has been accepted can only be redeemed at the store of the licensed Agent where the Bet was originally placed.

1.25   USE OF VAR

a)  Where the use of the VAR is requested, the fact that led to the referral to the VAR will be considered, for the purposes of these Regulations, to have occurred in real time (and not at the time specified in the decision). For example, someone selects the option for a goal to be scored at the end of the ten minutes from 20:00 to 30:00 and the goal is scored at 28:36 and at the same time the assistant referee indicates offsite. If a VAR is used and the goal is considered normal, the goal time will be considered to be 28:36 and the bet will be considered won.

b)  If we have settled a Bet and, due to a subsequent decision by a VAR, such settlement is found to be inaccurate, we reserve the right to reverse the settlement (provided that the VAR’s decision occurred prior to the completion of the match or other schedule related to the Bet). If we accidentally accepted a Bet during a VAR’s review, we have the right to cancel it.

c)  Bets placed between the occurrence of an event leading to a VAR’s revision and the relevant decision of a VAR will be considered void unless:

1)  the VAR’s review (and his subsequent decision) did not ultimately change the original decision.

2)  the VAR’s review (and his subsequent decision) amended the original decision but did not substantially affect the specific Bet (e.g. if the event being reviewed by the VAR is not related to the outcome of the specific Bet). All Bets which are not substantially affected by the VAR’s revision (and his subsequent decision) will apply.

3)  For the settlement of Bets, it shall be deemed that a VAR has been used if this is understood by the referee's gestures (e.g. gestures or interruption of the match for reviewing the incident) and/or the use of VAR is confirmed by the match report issued by the official body in charge of each event which is ultimately responsible for supervising the specific match. Where it is not clear whether the VAR was used due to lack of televised coverage and/or conflicting reports, the Company will settle the Bets based on the information it has from its providers, or from any reliable online or offline source.

1.26   ANTE POST BETS

For the Top Scorer selections, the final outcome is considered to be the outcome after the championship ends, including play offs or other qualifying matches, if any. If there is a final tie of 2 or more winners where there is no criterion concerning the winner (e.g. play offs or qualifying matches), Regulation 2.1 DEAD-HEAT will apply.

If the championship is interrupted following an incident of force majeure or following a decision of the competent federation/authority and does not continue, all Bets on the teams participating in the specific championship will then be considered void (VOID) and will be paid with an Odd of 1.00 (one point) (regardless of whether the competent federation/authority decides who will be the winner of the championship), except for selections regarding the championship which have already been decided (in whole or in part). The selections are considered to have been decided (in whole or in part), when they are already lost or won based on the scoring at the time the event was interrupted and there would have been no change in the outcome had the championship continued.

If a team/player participates in a championship and does not complete all of its/his matches following its/his decision or following a penalty, then all Bets concerning the team/player will be considered lost, except for the selections which have already been decided (in whole or in part). The selections are considered to have been decided (in whole or in part), when they are already lost or won based on the score at the time the team/player withdrew and there would have been no change in the outcome had the championship continued. 

For the Top Scorer selections, only the goals/points scored in the specific championship for which a Bet is placed will be counted, regardless of the team to which the Scorer refers. The team next to Scorer's name is for informational purposes only and will not be binding on the Company or the outcome. The goals of the First Scorer selection do not include any own goals that can be scored by the same player or another player, as well as goals that will be scored from any penalty shootout in any match after extra time. In case of a tie of 2 or more players, Regulation 2.1 DEAD-HEAT will apply.

For all ANTE-POST bets, regulation CONNECTED BETTING 1.10 shall apply.

SPECIAL RULES - CLARIFICATIONS

2.1   DEAD-HEAT REGULATION

In case of an event where only one winner had been taken into account and which is completed with more than one winner (all winners who get equal amounts/points share the victory), the DEAD HEAT Regulationshall apply. 

In case of a DEAD HEAT result, the selection (on which the Bet was placed and won along with the others) is deemed to be won and lost by half, and it is thus settled to full odds and half the stake.

 

For example:

If a Bet is placed for 10 euros with Messi as first scorer in Spain at an Odd of 10.00, if Messi wins but there is a tie with one more scorer, and there is a total of 2 scorers who have equal scores, then the winnings will be calculated as follows:

Stake amount/2 lines = 5 euros X Messi 10,00 = 50 euros winnings

If three players share the position of top scorer, the selection is deemed to be won by one third and lost by two thirds and settled to full odds and one third of the stake. 

 

For example: 

If a Bet is placed for 12 euros with Messi as first scorer in Spain at an Odd of 10.00, then the winnings will be calculated as follows:

Stake amount/3 lines = 4 euros X Messi 10,00 = 40 euros winnings

In case there is multiple Bet with DEAD HEAT Odds, then the Bet is settled according to the contestants who share the position of the winner.

 

For example:  

If there is a triple Bet worth 18 euros with the following selections:

Messi as first scorer in Spain at an Odd of 10.00

if Messi wins but there is a tie with another 2 players and there is a total of 3 players with equal scores,

Rooney as first scorer in England at an Odd of 12.00 (equal score with 1 other player, total of 2 players with equal scores)

If Rooney wins but gets an equal score with 1 other player, total of 2 players with equal scores,

Higuain as first scorer in Italy at an Odd of 20.00 (equal score with another 2 players, total of 3 players with equal scores) 

If Higuain wins but gets an equal score with another 2 players, total 3 players with equal scores,

then the winnings will be calculated as follows:

Stake amount /18 lines = 1 euro Χ Messi 10,00 Χ Rooney 12.00 Χ Higuain 20.00 = 2400 euros winnings.

2.2     RESULTS WHICH HAVE CHANGED AFTER THE EVENT ENDS

The result of an event is the result that occurs after the end of such event (either normally or following interruption). Subsequent decisions by a relevant sports body/bodies, which change the outcome of an event shall not be taken into account for Betting purposes.

 

2.3   DISPUTES

In case of a dispute over the outcome or result of an event, where applicable, statistics provided by our Live Betting service provider will be used for settlement purposes, unless there is compelling evidence that the service provider's statistics are wrong. Where no statistics by a service provider are available, we will use televised evidence to support the settlement of Bets. If for some reason, video evidence is not available, we will use independent evidence and settle the Bet according to the official sources/websites of the respective organizations. 

 

2.4   SPECIAL 'LIVE BETTING' REGULATIONS

Where applicable, the statistics provided by the supplier of the 'Live Betting Service', will be used to settle the Bets, unless there is conclusive evidence that the service provider's statistics are incorrect. Where no statistics are given by the service provider, videotaped evidence will be used in support of the correct way of settling the Bet. If for any reason there is no videotaped proof, independent proof will be used, and the Bet will be settled on the basis of the official sources/websites of the respective events.

Any dispute regarding the result must be recorded and reported to the Company before 5 days have elapsed from the end of the event.

No refunds of money nor cancellations of Bets placed during Live Betting shall be made under any circumstances. Bets accepted by the Company for specific events after their outcome is determined shall be considered void and will be paid at an Odd per unit (1.00). If a Bet is placed on an incorrect Odd due to the delayed coverage of the 'live' event, resulting in a team or selection having an obvious advantage, such Bet will be cancelled at an Odd per unit (1.00) regardless of whether the Bet wins or loses.

If there are printing errors, mistakes on receipts or obvious errors when entering the Bet in the Company’s Bet acceptance system, the Company has the right to consider that such Bets are void or calculate them based on the correct Odds, even if the error is discovered after the match is over.

In case of a goal, a yellow card, red card or penalty during Live Betting and the market remains open for placing Bets and the Bet is accepted, we reserve the right to cancel the Bet.

If the Live Bet market opens without any goal or red card and a Bet is accepted, we have the right to cancel it even if the error is discovered after the match is over.

In case of typographical and/or other obvious errors during live betting, Regulation 1.14 shall apply.

In cases of matches that have been interrupted during live betting, regulation 1.17 shall apply.

2.5    SAFE BETTING

Betting is fun for adults and is not a way of making money. Do not challenge your luck. Place Bets only for the amounts of money you can afford to lose. If you think you have a problem of addiction to gambling, consult the Mental Health Services of the Ministry of Health by calling 1454 and the Perseas Advisory Centre by calling 1456 if you are an adult up to 22 years old.

Otherwise, please address the Company or its intermediaries and consider withdrawing from Betting.

2.6    TRANSLATION OF THE REGULATIONS

The Company must send its licensed Authorized Representatives, Regulations translated into Greek, Turkish and English, which have been translated by the Press and Information Office and/or by professional translators following approval by the National Betting Authority, so that they may be posted in licensed premises, as foreseen by the Betting Law of 2019, as amended or replaced. In case of different wording of the Greek version with the version of another language, then the Greek version prevails.

2.7    PROCEDURES FOR THE COMBATING OF MONEY LAUNDERING

The Company and its intermediaries apply anti-money laundering procedures and suspicious transactions will be reported to the competent authorities.

2.8    PERSONAL DATA

a) Collection of Personal Data

All Personal Data of Members which are collected for any purpose are protected by the respective legislation on Personal Data of the Country.

Our Members' Personal Data will be collected:

-         for the development and management of new products and services of our Company, through the creation and dispatch of promotional material

-         to better understand how our Members use our products and services in order to improve the provision of our products and services

-         to be able to respond to any Member complaints

-         to prevent, detect, investigate and report a crime (financial or otherwise) or illegality in which the Member may be involved

-         for the correct and effective observance of the laws and regulations that govern our Company according to its capacity as a licensed Betting Company

-         to ensure corporate governance and compliance with all legal and regulatory obligations (AML, GDPR, etc.).

We may process Member Personal Data only:

1)     If this is necessary in order to fulfil any contract that we have with the Member

2)     If required by a legal obligation

3)     If the Member has consented to the processing

4)     If this is required for reasons concerning our legitimate interests

5)     If this is required for reasons of public interest

The procedures followed by our Company regarding the collection and processing of Member Personal Data are described in detail in our Company’s Privacy Policy which is posted on our official website at http://www.betathlon.com.cy/ at the section “Privacy Policy”.

It is our policy to retain Member Personal Data only for as long as this is necessary for the purpose for which it was collected, in accordance with the principles of data minimization and limitation of the storage period. For all the above reasons, the Personal Data of our Members will be kept for at least five (5) years from the date of their collection. It is noted, however, that the Company may not delete any of the Members' Personal Data, unless the 5-year period has elapsed, and the approval of the National Betting Authority has been obtained in advance. Furthermore, in some cases, specific Member Personal Data can be kept for longer than this five (5) year period because of possible legal obligations, legal interests, etc. Such cases could relate to:

-    Money laundering

-    Taxation

-    Player Protection

-    Civil law

-    Criminal law

-    Any other legal issues

b) Disclosure of Personal Data

We will not assign and/or disclose our Members' Personal Data to any third party/entity. Nevertheless, we reserve the right to disclose our Members' Personal Data to third parties:

1) If we are required to disclose or share our Members' Personal Data in order to comply with any legal or regulatory obligations, to enforce our terms and conditions and/or our regulations or to protect our rights, property and our safety as well as the safety of our Members or third parties.

2) If we need to cooperate with law enforcement services and other competent services where, in our estimation, the disclosure of Personal Data is necessary or related to any investigation of fraud or other illegal activity.

In particular, these authorities may be:

The National Betting Authority

Sports Governing Bodies (e.g. FIFA, IOC, TIU)

Anti-Money Laundering (AML) Organizations

Counter-Terrorism Financing (CTF) Organizations 

Law enforcement agencies (Police, Courts) of any country that may request such data from us.

Provided that the National Betting Authority will be informed in all the above cases.
